CM-10 Smoking Policy
It is the policy of Louisiana State University Health Sciences Center to respect the rights of both smokers and non-smokers. Accordingly, the University is in compliance with LSA-R.S.23:966 which prohibits discrimination in employment or conditions of employment for non-workplace related smoking of tobacco and LSA R.S. 40:1300.21 et sag. which regulates smoking in the office workplace.
The LSU Health Sciences Center reserves the right to limit or prohibit smoking at certain designated sites within its facilities and on its premises for reasons of public safety, protection of environmentally sensitive materials and to address the health concerns of non-smokers.
Buildings and/or rooms in which smoking is prohibited are designated by "NO SMOKING" signs. A building designated as LIMITED SMOKING will limit smoking to private offices occupied exclusively by smokers, and in designated smoking areas, if any.
In ALL buildings, smoking is prohibited in restrooms, stairwells, elevators, classrooms, laboratories, and seminar rooms.
Requests by individual employees to modify smoking policies within a building shall be directed to the appropriate dean or senior administrator. If approved by the Dean/Administrator, recommendation will be forwarded to the Chancellor for final determination.
Any non-smoking employee who objects to smoke in his/her work environment should do so in writing to their immediate supervisor. The supervisor shall forward the objection through the appropriate administrative channels to the responsible dean or senior administrative officer. The dean or senior administrative officer shall meet with the complainant, their immediate supervisor and other appropriate officials, as necessary, in an attempt to reach a reasonable accommodation insofar as possible between the preferences of non-smoking and smoking employees.
It is the responsibility of supervisors to insure that employees comply with the Smoking Policy. Violating the Smoking Policy may result in a written reprimand, suspension, or termination. The severity of the disciplinary action will be based upon the prior disciplinary record of the individual and/or the nature of the rule violation. For example, smoking near combustible materials creates a much greater hazard than smoking in an area that contains no hazard and would be subject to severe disciplinary action up to and including termination.
